  • Post category:Insecurity

The incident described involves the arrest and subsequent legal proceedings against a 20-year-old suspected armed robber named Gafar Odusoya in Lagos State, Nigeria. According to reports, Odusoya and his gang broke into a lady’s apartment in the Isale-Oja area of Agege, Lagos, and robbed her of valuable items such as a gold necklace, jewelry, and ATM cards. They also used her ATM cards to withdraw money forcefully.

While the other members of the gang were attempting to escape, Odusoya allegedly stayed back and engaged in non-consensual sexual activity with the victim. The victim reportedly pretended to enjoy the act while her neighbors intervened and apprehended Odusoya. He was subsequently handed over to the local police for interrogation.

During the police investigation, it was discovered that Odusoya had indeed participated in the robbery and committed the rape. As a result, he was charged with conspiracy, armed robbery, and rape. However, when he was arraigned before the Ogba Magistrate Court, he did not enter a plea. The prosecutor, DSP Clara Olagbayi, requested that the court refer the matter to the Director of Public Prosecutions (DPP) for legal advice.

The presiding magistrate, Mrs. H.B. Mogaji, granted the prosecutor’s request and ordered Odusoya’s remand in custody pending the outcome of the DPP’s advice. The prosecutor was directed to duplicate the case file and send it to the DPP. The court adjourned the matter for mention, and Odusoya was remanded in custody at the Kirikiri Correctional Centre in Lagos.

The DPP’s advice will determine whether the case should be transferred to the High Court or if the magistrate court has jurisdiction to proceed with the trial. The subsequent legal proceedings will depend on the DPP’s recommendations and the decision of the court regarding jurisdiction.
