Femi Falana, a prominent Human Rights lawyer and Senior Advocate of Nigeria, has supported the Nigerian Labour Congress (NLC) and its affiliates in their decision to proceed with the planned strike and protest starting on August 2, 2023. He countered the federal government’s claim that there was a court order restraining the NLC from taking action, stating that no court has issued such an injunction.

In a letter to the Permanent Secretary dated July 28, 2023, Falana clarified that participating in peaceful rallies is within the constitutional rights of Nigerians and should not be classified as an industrial action or strike. He cited a previous court case that upheld the right of Nigerians to protest without police permits.

Despite appeals from the Tinubu government and negotiations with the federal government, the NLC remains firm in its decision to proceed with the strike and protest against the fuel hike resulting from subsidy removal. The labor leaders walked out of a meeting with government representatives, expressing dissatisfaction with the government’s handling of the situation and implementation of agreed-upon palliative recommendations.
